Tivoli Giveaway Rules:
 
Eligibility: NO PURCHASE OR FINANCIAL CONTRIBUTION IS REQUIRED TO ENTER OR TO WIN. MAKING A PURCHASE OR CONTRIBUTION WILL NOT IMPROVE AN INDIVIDUAL"S CHANCES OF WINNING. The Tivoli Giveaway (the "Sweepstakes") is open to all legal U.S. residents who are at least eighteen (18) years of age, except employees, directors and officers (or any persons who have been employees, directors or officers in the past twelve months) of The Friends of mvyradio, mvyradio.com, WMVY Radio, Aritaur Communications, Incorporated or any of its co- or wholly-owned companies, and the immediate families or household members of each employee. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law or regulations. 
 
How to enter: The Sweepstakes begins at 8:00 p.m. EST on November 24, 2009 and ends at 5:59 a.m. EST on December 16, 2009 ("Sweepstakes Period"). Any eligible individual who contributes to FRIENDS OF MVYRADIO during the Sweepstakes Period will automatically be entered into the Sweepstakes. To enter without contribution, type or hand print your full name, complete address with zip code, your date of birth, and day/evening/cell phone numbers with area code on a standard size postcard* and mail with the proper postage affixed: c/o Fall 2009 Sweepstakes, FRIENDS OF MVYRADIO, Post Office Box 1148, Tisbury MA 02568. All mail-in entries must be postmarked during the Sweepstakes Period and received by December 15, 2009. Regardless of method of entry, only one (1) entry per person/per household. Duplicate entries will be disqualified. All entries become the property of Friends of mvyradio.com and will not be acknowledged or returned. *Specifics available at the USPS website. 
 
Prize(s): One (1) individual winner will receive the following prize (Estimated retail value: $599.00):

• One Tivoli "NetWorks" radio. Value $599.00

All prizes will be sent to the winner no later than 30 days after the official notification of winning. Friends of mvyradio will ship the prizes via ground carrier and will pay for the associated costs. Winner will be responsible for any expenses not specifically included herein, and all applicable federal, state and local taxes. The prize(s) is non-transferable and no substitution or cash equivalent is allowed. If, by some unforeseeable situation, a prize becomes unavailable, mvyradio.com reserves the right to substitute prize for one of equal or greater value.  
 
Selection of winner: Winner will be determined from among all eligible entries in a random drawing on December 16, 2009 at 11 am EST. The drawing will be conducted by representatives of mvyradio.com, whose decisions are final and binding in all matters relating to this Sweepstakes. Winner will be notified by telephone, mail or e-mail on or about December 16, 2009, and will be given instructions on the prize(s) will be claimed and delivered. Winner will be required to sign and return an affidavit of eligibility, and liability release within fourteen (14) days of notification or prize will be forfeited and awarded to an alternate winner. Odds of winning depend on the number of eligible entries received. Limit of one (1) prize per individual/household per year from mvyradio.com.  
 
Release of Liability: By participating, you release mvyradio.com, WMVY Radio, Aritaur Communications, Incorporated or any of its co- or wholly-owned companies, and the immediate families or household members of each and all other associated with the development and execution of this Sweepstakes, from a) all responsibility of the functioning or service warranties of the prizes awarded; b) any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize. Furthermore, you agree that these entities are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize(s). Additionally, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, entrant agrees that, by entering the sweepstakes, (i) any and all disputes, claims, and causes of action arising out of or in connection with the sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the sweepstakes, but in no event attorney"s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

Use of Name for Promotional Purposes: By entering in this promotion, all entrants verify that Friends of mvyradio, WMVY, and mvyradio.com have the permission to use the winner(s) name, voice, and/or likeness without compensation. 
 
Additional Rules: Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void mvyradio.com is not responsible for: (i) lost, late, misdirected, damaged, garbled, postage due, or unreadable entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by mvyradio.com on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant"s or any other person"s computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of mvyradio.com, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. The Friends of mvyradio reserves the right to: (i) permanently disqualify from any sweepstakes any person it believes has intentionally violated these official rules; and (ii) suspend, modify or terminate the Sweepstakes if Friends of mvyradio believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity or proper play of the Sweepstakes. If Sweepstakes is terminated before the end date, Friends of mvyradio will determine the winner from all eligible entries received as of the termination date. These Rules and this Sweepstakes are governed by and controlled by the laws of the Commonwealth of Massachusetts, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the Commonwealth of Massachusetts, Dukes County. The parties consent to the jurisdiction of the state courts of Massachusetts and the federal courts located with the Commonwealth of Massachusetts and Dukes County with respect to any action, dispute or other matter pertaining to or arising out of this Sweepstakes.

Privacy: By entering the Sweepstakes, you agree to receive informational and promotional communications periodically from FRIENDS OF MVYRADIO and/or mvyradio.com. If you want to opt-out of receiving communications from FRIENDS OF MVYRADIO, make your request via e-mail to web@Friendsofmvyradio.org.  
 
Legal Notice: Any attempt by any person(s) " whether or not an entrant " to intentionally destroy, damage, tamper with, or vandalize the websites of mvyradio.com and/or friendsofmvyradio.org or to interfere with the operation of these sweepstakes shall be considered a violation of both civil and criminal laws. Should this occur, Aritaur Communications, Inc., Friends of mvyradio, and/or mvyradio.com reserve the right to seek compensatory damages and to pursue any and all available remedies against any such person(s) to the fullest extent permissible by law.
